Disability rights group wins records' battle vs. NY Ed Department
A judge recently ruled in favor of Disability Rights New York in a battle to obtain records from the state Education Department related to a school for students with autism in Westchester County. The group had argued that the Education Department was unlawfully withholding documents that inhibited the organization’s ability to investigate serious allegations of abuse, neglect and civil rights violations at the private residential school.

State Authorities Agree to More Hands-On Approach to Tracking Discrimination in California Schools
California will play a more active role in ensuring school districts don’t discriminate against students with disabilities, English learners and Black students, under a legal settlement announced this week. The agreement (PDF) between the state and the American Civil Liberties Union of Northern California requires state authorities to visit schools, interview teachers, look at individual students’ records and take more hands-on steps to see if a school has a pattern of discriminating.

English learners who are also identified as students with disabilities experience unique needs in K-12 schools—and their teachers need specialized, interdisciplinary training, experts say. This dual-identified student cohort accounted for 15.8 percent of the total English-learner population in fall 2021, according to the updated federal data. For teachers to understand how students acquire language and how that works concerning their special education needs, they need comprehensive training that goes beyond standardized training focused either on bilingual education or special education.
